What is Maritime Law?
Maritime law applies to cases involving injuries, loss of cargo, transportation of passengers and cargoes, ship owners, crew, pollution, the marine insurer, and many other issues that occur on or near bodies of water. The term Maritime law is sometimes used generically to land locked bodies of water, however, state law is applied in those cases. The term Maritime law generally is applied to incidents that occur on or near navigable waterways that can lead to the sea or on the sea itself (this is where federal law comes into play due to the possibility of interstate commerce).
Why do I need an attorney that specializes in Maritime Law?
If you have some type of concern that happened on or near a body of water, it is important to speak with a lawyer familiar with Maritime law to determine if you have a claim. An attorney can determine which jurisdiction (state or federal) applies to your particular situation. An attorney who is familiar with the numerous federal laws that are involved in Maritime law, such as: The Jones Act, General Maritime Law, Death on the High Seas Act, and the Longshore and Harbor Workers' Compensation Act will be able to evaluate what laws apply in your case. Different statute of limitations apply to the different jurisdictions and particular acts. It simply makes sense to hire an attorney who can best assess your particular Maritime situation and help you achieve fair results.
